President of the Nigerian Bar Association (NBA), Yakubu Maikyau has expressed deep concern regarding the actions of certain legal practitioners and the judiciary amidst the ongoing dispute over the Kano Emirate crisis.
The
controversy stems from conflicting interim injunctions issued by two courts in
Kano State. Justice S. A. Amobeda of the Federal High Court in Kano ordered the
eviction of reinstated Emir Alhaji Muhammadu Sanusi II from Gidan Rumfa palace
on Tuesday. However, Justice Amina Adamu Aliyu of the Kano State High Court
issued a separate order restraining law enforcement agencies from evicting or
harassing Sanusi.
The
power struggle between Sanusi and Aminu Ado Bayero, the 15th Emir of Kano, has
incited protests among their respective supporters in Kano.
In
response to these developments, Maikyau, a Senior Advocate of Nigeria (SAN),
released a statement on Wednesday expressing dismay over the conduct of both
counsel and judges involved in the cases. He emphasized the urgent need for a
review of their professional conduct and called upon the heads of the
respective courts to investigate and report any findings to the National
Judicial Council (NJC).
Maikyau
denounced the proceedings as a "circus" that has brought disgrace and
shame to the legal profession in Nigeria. He emphasized the clarity of legal
precedents regarding chieftaincy disputes and called for accountability among legal
practitioners and judges.
He
asserted that the NBA will investigate the conduct of the counsel involved and
initiate disciplinary action if necessary. Maikyau reaffirmed the NBA's
commitment to upholding the integrity, welfare, and independence of the Bar and
the Judiciary, promising to hold accountable any individual whose actions tarnish
the reputation of the legal profession.
